Terms and Conditions for Travel Agents

1. Introduction

These Terms and Conditions ("Agreement") govern the relationship between the travel agent ("Agent," "You," "Your") and Booked By Dani LLC ("Company," "We," "Our," "Us"), a company registered at 8735 Dunwoody Pl STE R, Atlanta, GA 30350, with phone number 470-824-8217. By agreeing to work with us and utilizing our services, You acknowledge and accept these Terms and Conditions and confirm that You will adhere to them.

2. Scope of Service

Booked By Dani LLC acts as an intermediary between You and various suppliers, including but not limited to airlines, hotels, car rental companies, tour operators, and other service providers ("Suppliers"). We will make bookings with these Suppliers on Your behalf, based on the instructions You provide. All bookings are subject to the terms and conditions of the respective Suppliers.

3. Agreement to Supplier Terms

By working with Us, You agree that any booking made through Us, including all travel arrangements or services, is subject to the individual terms and conditions of the respective Supplier. You acknowledge that these terms may include, but are not limited to, cancellation policies, payment schedules, and other legal obligations imposed by the Supplier.

You understand and agree that it is Your responsibility to ensure that You are fully aware of and accept the Supplier’s terms before confirming any booking. Booked By Dani LLC shall not be held liable for any disputes arising from these terms.

4. Release of Liability

By agreeing to these Terms and Conditions, You agree to release and hold harmless Booked By Dani LLC, its owners, employees, and agents from any and all legal obligations, liabilities, or claims arising from the bookings or arrangements made through Us. This includes, but is not limited to, any claims, damages, losses, or costs incurred by You or Your clients as a result of changes, cancellations, delays, or other issues caused by the Suppliers.

You further agree that Booked By Dani LLC shall not be held responsible for any direct or indirect damages, including financial losses, emotional distress, or any other consequences, arising out of any Supplier’s actions or inactions.

5. Credit Card Authorization and Payment Terms

By agreeing to these Terms and Conditions, You authorize Booked By Dani LLC to securely store Your credit card information for the purpose of processing payments related to travel bookings. This authorization allows Us to charge the card on file when a payment request is received, whether it is for booking confirmation, deposits, final payments, or any other required charges in connection with travel arrangements made on Your behalf.

You agree that all credit card payments made through Booked By Dani LLC are final, and You will be responsible for any fees, charges, or penalties that may arise from the use of the stored card information for payments. You understand that if payment cannot be processed on the card provided, Your bookings may be subject to cancellation or delay until payment is successfully made.

6. Changes and Cancellations

You acknowledge that any changes, cancellations, or modifications to bookings may be subject to fees or penalties as imposed by the Supplier. Booked By Dani LLC is not responsible for any additional charges that may result from such changes or cancellations. It is Your responsibility to communicate and manage any such changes directly with the Supplier.

7. Client Communication and Responsibility

You are responsible for ensuring that Your clients are informed about all relevant terms and conditions, including those of the Supplier, related to any travel booking or service provided. It is also Your responsibility to inform Your clients of any relevant changes, cancellations, or other updates as communicated by the Supplier.

8. Confidentiality and Data Protection

You agree to handle all client information in accordance with applicable data protection laws, ensuring that personal data is kept secure and used only for the purposes of making bookings and providing travel-related services. Booked By Dani LLC will also adhere to these regulations when processing Your personal information in the course of providing services.

9. Termination of Agreement

Either party may terminate this Agreement at any time with written notice. Upon termination, You will remain responsible for any outstanding fees or obligations that arise from existing bookings. Any provisions of this Agreement that by their nature should survive termination (such as liability releases) shall remain in effect after termination.

10. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the state of Georgia. Any disputes arising under or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts located in Atlanta, Georgia.

11. Acceptance

By acknowledging and signing  these Terms and Conditions, You confirm that You have read, understood, and agreed to abide by all terms, including the legal obligations associated with the bookings made with Suppliers. Your acceptance and continued use of Our services will be deemed as Your consent to the terms outlined above, including the authorization to store and charge the credit card on file.
